These Terms of Service ("Terms") govern your use of the EyeCareWorks website at eyecareworks.com and the virtual assistant services provided by EyeCareWorks LLC ("EyeCareWorks", "we", "us"). By using our website or services, you agree to these Terms.
EyeCareWorks LLC is a Texas limited liability company located at 8080 Westpark Drive, Houston, Texas 77063. We place trained, HIPAA-certified virtual assistants with optometry and ophthalmology practices in the United States.
By visiting our website, booking a call, submitting a form, or engaging our services, you accept these Terms and our Privacy Policy. If you use our services on behalf of a practice or company, you confirm that you are authorized to bind that organization. If you do not agree, please do not use our website or services.
If you sign a service agreement with us, that agreement controls if it conflicts with these Terms. If you apply to work with us, any engagement is governed by a separate written agreement.
EyeCareWorks recruits, screens, trains, and matches virtual assistants who support eye care practices with tasks such as scheduling, patient communication, insurance verification, billing follow-up, and scribing. Assistants are engaged through EyeCareWorks and work remotely inside the systems your practice provides.
EyeCareWorks does not provide medical, legal, coding, or billing advice. Your practice remains responsible for its clinical decisions, patient care, coding and billing accuracy, and compliance with the laws that apply to it.
Our current pricing is published on our Pricing page. Services are billed at a flat hourly rate for tracked working hours and invoiced weekly. There are no setup fees and no long-term contracts.
You agree to keep a valid payment method on file and to pay each invoice when due. Questions about an invoice should be raised in writing within 30 days of the invoice date. We may pause services while an invoice remains unpaid.
Payments are made to EyeCareWorks only. Please do not pay an assistant directly.
You may cancel at any time by notifying us in writing. There is no notice period and no cancellation fee. Hours worked up to the time of cancellation remain billable.
We may suspend or end services if you breach these Terms, fail to pay, misuse the services, or direct an assistant to act unlawfully or in a way that puts patient information at risk.

If an assistant is not the right fit, tell us. We will work with you to provide a replacement at no additional placement cost.
Every assistant completes HIPAA training and holds a current third-party HIPAA certification before placement. Your assistant signs a Business Associate Agreement directly with your practice before accessing patient information.
Your practice remains responsible for its own HIPAA compliance, including the policies, training, and access controls that apply to the systems you share. Please do not send protected health information to EyeCareWorks through our website, forms, or email. Our website is not designed to receive it.
You agree not to use our website or services for anything unlawful or harmful, including attempting to gain unauthorized access to our systems, introducing malicious code, scraping or copying content without permission, or submitting false or misleading information.
The EyeCareWorks name, logo, website content, and training materials are owned by EyeCareWorks LLC or its licensors and are protected by intellectual property law. You may not copy, reproduce, distribute, or create derivative works from them without our written permission. You may use our website only for its intended purpose.
Our website and services may link to or work with third-party tools, such as scheduling software, payment processors, and your practice's electronic health record system. Those services are governed by their own terms and privacy policies, and we are not responsible for them.
Our website and services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the website will be error-free or uninterrupted, or that any particular result will be achieved through the services.
To the fullest extent permitted by law, EyeCareWorks will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the website or services. Our total liability for any claim will not exceed the amount you paid us for the services in the three months before the event giving rise to the claim.
You agree to defend and indemnify EyeCareWorks and its owners, contractors, and agents against claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or of any law, or from the access, instructions, and information you provide in connection with the services.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Before filing a claim, you agree to contact us and make a good-faith effort to resolve the dispute for at least 30 days. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date and takes effect when posted. Your continued use of the website or services after that date means you accept the updated Terms.
These Terms, together with our Privacy Policy and any service agreement you sign with us, are the entire agreement between you and EyeCareWorks about the website and services. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent.
